Norman spends as much time as he can with his wife, children, grandchildren and pet Brussels Griffon. He plays at golf, like to plan trips, travel, read and drink wine.

Representative Matters Highlights

Represented a national financial institution in defending a lender liability claim brought by two governmental entities seeking in excess of $25 Million in damages. In the same case, prosecuted a counterclaim against one of the governmental entities. After a two week trial, the claims of the governmental entities were denied, and client was awarded judgement in excess of $32 Million.

Represented a multi-state healthcare network in defending a claim of breach of contract seeking more than $23 Million in damages brought by the holder of a note and mortgage on an office building in which the network had a financial interest. The trial court awarded judgment to the healthcare network and against the note holder.

Prosecuted a claim by a national defense contractor claiming breach of representations and warranties in an agreement by which it purchased the assets of a competitor. After a jury trial, the defense contractor was awarded damages in excess of $9 Million.

Represented a software developer in prosecuting a claim for breach of a non-disclosure agreement entered into when the parties were negotiating the acquisition of the software developer. Judgment was awarded to the software developer after a three week arbitration proceeding. Damages were assessed in the several millions of dollars, and an injunction was entered against the respondent.

Successfully defended a national retail store chain against a claim by anchor store tenants and co-tenants seeking an injunction and damages for allegedly breaching covenants not to compete by selling allegedly competing merchandise.

Represented lessee of over 100,000 square feet of commercial real estate used as a call center in a dispute with the commercial office building owner regarding the building owner’s alleged failure to properly mitigate damages after the lessee breached the lease by improperly attempting to terminate the lease early. After three weeks of trial, judgment was awarded in favor of the lessee.
